By enrolling in the Badger Carwash Membership Program, you agree to be bound by these Terms and Conditions. Please read these Terms carefully before enrolling. AquaShine Holdings, LLC, dba Badger Carwash, owns and operates  Badger.

1. Membership Overview

• Program Description: The Badger Carwash Membership Program, operated by AquaShine Holdings, LLC dba Badger Carwash, provides Members with access to car washes at the Badger Carwash location at 109 E. Ave B, Lampasas, TX 76550, according to the terms outlined below. Badger Carwash is open 24 hours per day, subject to periodic closures.
• Membership Tiers: We offer tiered Membership options: Deluxe, Premium, and Ultimate. See Section 4 (“Fees and Payment”) for details on wash packages and monthly fees associated with each tier.
• Wash Limit: Members are limited to a maximum of fifteen (15) washes per calendar month, regardless of Membership tier. Unused washes do not roll over to the next month. The Membership provides the specified wash package only; no upgrades or downgrades to other wash packages are permitted during a Membership wash. Members are limited to one (1) wash per vehicle per day.
• Vehicle Limitation: Membership is tracked per vehicle with that vehicle’s license plate and is non-transferable to other vehicles unless you enroll in a Family Account.
• Family Accounts: Family accounts are available for households with multiple vehicles. Please contact Badger Carwash at 512-575-3031 or [email protected] to inquire about Family Account pricing.
• Vehicle Restrictions: Membership is valid only for standard passenger vehicles. Oversized vehicles are prohibited. Specifically, vehicles exceeding 7 feet in height, or wider than 96 inches total width, vehicles longer than a traditional 4-door long bed truck, vehicles with trailer hitches, full-size Hummer vehicles and trucks with ladder racks are not permitted. Badger Carwash reserves the right to determine vehicle eligibility at its sole discretion. Trucks with uncovered beds are not permitted unless completely empty and free of debris. Members are responsible for vehicle suitability for an automatic car wash and prohibited from using the wash if debris or trash is likely to be blown out. 
• Periodic Closures: Badger Carwash may be temporarily closed due to repairs, maintenance, weather, water restrictions, or other unforeseen circumstances. We will make reasonable efforts to notify members of closures via Google, Facebook updates, or barrier cones in the access lane. Membership fees continue during closures as Memberships provide access to washes when operational, not guaranteed continuous service. No refunds or credits for closure time due to any reason including weather or maintenance.
• Wash Malfunctions: In case of malfunction, notify Badger Carwash immediately at 512-575-3031.
• Fair Usage Policy: Membership is for personal vehicle washing and Badger Carwash reserves the right to monitor and terminate Memberships for excessive, abusive, or commercial use.

2. Member Account Information

• Accurate Information: You agree to provide true, accurate, current, and complete personal information to Badger Carwash and to update it as necessary.

3. Membership Term and Renewal

• Recurring Monthly Charge Agreement and Payment Authorization: There is a recurring monthly charge for your Wash Club subscription. By providing payment information, you warrant authorization to use the payment method and authorize charges for Subscriptions and Orders. Clicking “Done” during registration confirms agreement to these Terms.
• Initial and Recurring Charges: Initial monthly charges are set during purchase and may vary. Prices may change without notice.
• Membership Duration: Membership starts on enrollment and automatically renews monthly. It continues until canceled or terminated.
• Cancellation Policy: To cancel, customers must call 512-575-3031 or email info @badgercarwash.com five days prior to renewal. Cancellations less than five days prior may result in one more month’s charge.
• Chargebacks:
  • Chargeback Responsibility: Member is responsible for all chargebacks as wash service is rendered upon completion.
  • Dispute Resolution Process: Prior to a chargeback, Member must contact Badger Carwash to resolve billing disputes. Then, attempt mediation. If unsuccessful, settle via small claims court in Lampasas County, Texas.
  • Chargeback Costs: Member pays all court costs, attorney fees, and a $500 administrative fee if court rules in favor of Badger Carwash.
  • Verification: Badger Carwash uses usage tracking software and HD video to verify washes in disputes.

4. Fees and Payment

• Monthly Membership Fees: Monthly fees are: Deluxe – $25.00, Premium – $30.00, Ultimate – $35.00 per month. Prices are subject to change without notice. Refer to the pay station, www.badgercarwash.com or call 512-575-3031 for current pricing. 
• Payment Method: Fees are automatically charged monthly to your provided payment method. Keep payment information current.
• Failed Payments: If payment fails, Badger Carwash may make one attempt to reprocess payment. Members are responsible for insufficient funds fees incurred by Badger Carwash for failing to maintain a sufficient amount of funds in their account for their subscribed membership levels. Unsuccessful payment may lead to Membership suspension until updated payment is processed. You remain responsible for all charges.
• Taxes and Other Charges: Applicable taxes and charges are additional to Membership fees.

5. Membership Usage and Restrictions

• Wash Types: Membership provides the wash package of your chosen tier only (Deluxe, Premium, or Ultimate), up to monthly limit. No upgrades/downgrades.
• Fair Use: Membership is for personal use; Badger Carwash may terminate Memberships for excessive use, abusive, or commercial use.
• Operating Hours: Membership washes are available 24/7, subject to closures.
• Bay Availability: Bay availability is not guaranteed, first-come, first-served.
• Single Use Per Visit: One wash per vehicle visit. Multiple washes per visit are not permitted.
• Non-Transferable: Memberships are non-transferable and for registered Member/vehicles only.
• Vehicle Condition Restrictions: Members are responsible for vehicle condition suitable for automatic car wash. Badger Carwash is not liable for vehicle damage.

6. Cancellation and Termination

• Cancellation by Member: To cancel, customers must call 512-575-3031 or email info @badgercarwash.com five days prior to renewal. Cancellations less than five days prior may result in one more month’s charge.
• Termination by Badger Carwash: Badger Carwash may suspend or terminate Membership at any time, with or without cause/notice, including for: Terms violation, Membership abuse, payment failure, disruptive conduct, negative online reviews without opportunity to rectify, excessive debris/trash, or any other reason.
• Refunds Upon Termination:
  • Member Cancellation: No refunds for partial months or unused washes.
  • Badger Carwash Termination Without Cause: Pro-rata refund may be provided at Badger Carwash discretion.
  • Badger Carwash Termination For Cause: No refunds.
• Effect of Cancellation/Termination: Membership access ceases upon cancellation/termination.

7. Disclaimer of Liability

• Vehicle Damage Disclaimer: Badger Car Wash is not responsible for damages caused by:

  • Vehicles Taller Than 84 Inches
  • Vehicles Wider Than 96 Inches 
  • Trucks with Uncovered Beds That Are Not Completely Empty and Free of Any Kind of Debris
  • Full-Size Hummer Vehicles
  • Trucks with Ladder Racks
  • Trucks with Trailer Hitches
  • Vehicles with Bicycle Racks or Scooter Racks
  • Vehicles 7 Years or Older
  • Bug Shields or Rain Guards
  • Windshields with Chips/Cracks
  • Non-Factory Parts/Accessories
  • Externally Attached Items
  • Pre-Existing Paint Imperfections/Damage
  • Prior Vehicle Damage
  • Driver Negligence

   

• No Warranty: Badger Carwash provides Membership/services “as is” and “as available” without warranties.
  
  
• Risk: Car washing is at your own risk. Badger Carwash (AquaShine Holdings, LLC) is not responsible for vehicle damage to the extent permitted by law, including pre-existing conditions, scratches, or damage from improper use.
  
  
• Customer Damage: Please be advised that customers are responsible for any and all damages they cause to Badger Carwash property, including the equipment, bays, and surrounding areas. Any repairs or replacement costs resulting from customer negligence or misuse will be the sole responsibility of the customer.

8. Modification of Terms

• Modification of Terms: Badger Carwash (AquaShine Holdings, LLC) may modify these Terms at any time. Notice will be posted at www.badgercarwash.com. Review website for updates. Continued Membership use means acceptance of revised Terms. Prices are subject to change without notice. See pay station, website or call for current pricing.

9. Program Changes

• Badger Carwash (AquaShine Holdings, LLC) may modify, suspend, or terminate the Membership Program with reasonable notice (except for price changes).

10. Governing Law

• Texas law governs these Terms.

11. Entire Agreement

• These Terms are the entire agreement between you and AquaShine Holdings, LLC dba Badger Carwash.
